Travel Rights at Airports and Borders

TSA Security Checkpoints

• You have the right to refuse a full-body scan and opt for a pat-down instead
• TSA cannot detain you without reasonable suspicion
• You can request a private screening if you're uncomfortable with the public process
• TSA cannot search the contents of your phone or laptop without a warrant

Your Rights When Driving

During a Traffic Stop:

• Stay calm and keep your hands visible (e.g., on the steering wheel).
• If it's dark, turn on your inside car light.
• Tell the officer before you reach for your license, registration, or insurance.
• Give the officer these documents if they ask for them.
• You generally have the right to remain silent and not answer questions beyond providing your documents.

Vehicle Searches:

• Police usually need a warrant, your permission (consent), or a strong reason (probable cause) to search your car.
• You have the right to say NO to a search. Clearly state: "I do not consent to a search."
• Saying no isn't an admission of guilt.

DUI Checkpoints/Stops:

• Field sobriety tests (like walking a line) are often voluntary. You can usually refuse these.
• Refusing a breathalyzer or blood test might lead to penalties like license suspension, even if you aren't charged with DUI (laws vary by state).
• You still have the right to remain silent.

Interacting with Police

If Police Question You:

• You have the right to remain silent (5th Amendment). You don't have to answer questions about where you're going, what you're doing, or anything else.
• You can say: "I am exercising my right to remain silent."
• In some states ('Stop and Identify' states), you might have to give your name if police suspect you of a crime.
• Ask "Am I free to leave?". If they say yes, you can calmly walk away.
• Never lie to the police.

If You Are Arrested:

• Do not resist the arrest, even if you feel it's unfair.
• Say clearly: "I wish to remain silent and I want a lawyer."
• Do not say anything else, sign anything, or make any decisions without a lawyer present.
• You usually have the right to make a local phone call.

Recording Police:

• In most public places, you generally have the right to record police officers (video and audio) as long as you don't interfere with their duties.
• Laws can vary, so be aware of your local rules.

Filing Complaints:

If you believe your rights were violated, you can file a complaint against the officer(s) involved. You can usually do this through the police department's internal affairs division or a civilian oversight board. Gather details like officer names, badge numbers, patrol car numbers, witness information, and specific events.

Your Privacy Rights

Protection from Searches (4th Amendment):

• Your body, home, car, and belongings are generally protected from unreasonable searches by the government.
• Police usually need a warrant based on probable cause to search your home.
• There are exceptions (like emergencies or if evidence is in plain view), but you generally don't have to let police into your home without a warrant.
• You can refuse to consent to a search of your property or person.

Your Digital Devices (Phones, Laptops):

• Police generally need a warrant to search the data on your phone or computer, even if you are arrested (Riley v. California).
• At the border (including airports for international travel), rules are different, and agents have more power to search devices. You can refuse to give passwords, but your device might be detained.
• Consider using strong passwords and encryption.

Protecting Your Information:

• Be mindful of what personal information you share.
• You have the right to remain silent to protect yourself from self-incrimination (5th Amendment).
